Please do not enter trails with wrong way (W) signs. Confine all riding to established single track. This does not include open fields, dirt piles, grassy berms etc. STAY ON THE TRAIL. The roads of Eagle Bay are now county roads. Riding on the pavement within the subdivision with unlicensed bikes is illegal. Staging around the water tower is no longer allowed. You must stage at the entrance to EB on the gravel lot behind the kiosk or down 642 by the river under the power line and against the tree line. Families with kids learning to ride can use the river staging as a learning area. Activity must be confined to within 100 yds of this location. Helmets must be worn at all times. All bikes must be able to pass the J1287 sound test at 96dBA. Members are allowed to bring guests. The guest fee is $40. The $40 fee and the guest waiver must be completed before the guest rides. Members areresponsible for the actions of their guests. No riding before 9 AM (12 PM 2nd Sat. April - 1st Sat. of May) or after sundown. During Deer Hunting and Spring Gobbler seasons riding is restricted, normally to Wednesdays and Sundays but it is your obligation as a club member to monitor the email group for updates to riding restrictions. If trail is muddy either hold off riding or be responsible to prevent or repair ruts. It generally takes a day for each 0.2 inches of rain for the course to dry sufficiently. Be prepared to reroute or clear obstacles from trail. Major changes to trail alignment must be approved. You must be responsible to police the trails. Confront and get names of anyone you do not know. Illegal riding jeopardizes your riding. Please call Don (cell (540) 809-5155) and report any issues at Eagle Bay. Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement S E Ventures Inc. owns certain property known as Eagle Bay on the Potomac which consists of approximately 456 acres of roads, lots and undeveloped land (hereinafter “the Property”). The Property contains many known and unknown dangers typical of property that is undeveloped or under development, including without limitation, construction equipment and activities. The releaser (as defined below), desires to enter the Property for the Activity of motorized recreation (hereinafter the “Activity”) and agrees to do so only upon execution of this Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement (“Agreement”). In consideration of being permitted to enter the Property for the Activity, the undersigned and any minor immediate family member listed below (collectively the “Releasor”), for themselves and on behalf of their personal representatives, executors, administrators, successors, assigns, heirs and next of kin agree to the following: The Releasor shall immediately inspect the Property upon entering it and warrants that their entry constitutes acknowledgement that they have inspected the property and find it safe and suited for the purpose of the Activity. The Releasor agrees that if at any time they believe something on the Property is unsafe or weather conditions create an unsafe condition, that they will immediately cease the Activity and leave the Property. The Releasor assumes full responsibility for and risk of bodily injury, death or property damage due to the negligence of Releasees (as identified below) or otherwise, while on the Property for any purpose and/or while participating in the Activity. The Releasor recognizes and understands that there are inherent risks and dangers associated with the Activity that could cause severe bodily injury, disability or death. Further, the risks and dangers may be caused by the negligence or the negligent failure to act of the Releasees or others. All the risks and dangers associated with being on the Property are assumed notwithstanding. The Releasor covenants not to sue and hereby releases, waives, and discharges S E Ventures and each of its officers, directors, employees, contractors and shareholders, S.E. Veazey, Joy Veazey, The Washington Area Trail Riders Inc., any emergency responder, any lot owner within the Property, managers and officers of said Activity and the Eagle Bay Homeowners Association from all liability, under any legal theory, for any and all claims, demands, losses or damages to the Releasor on account of any injury, including without limitation, the death or disability of Releasor or damage to property, all of which is caused or alleged to be caused by the negligence of the Releasees or otherwise. Such covenant, waiver and release shall be binding upon any insurance provider of Releasor and Releasor hereby waives its carriers’ rights of subrogation under any policy. The Releasor hereby agrees to defend, indemnify and hold the Releasees harmless from any loss, liability, damage or cost they may incur due, in any manner or degree, from their presence on the Property, and whether caused by the negligence of the Releasees or otherwise. The Releasor hereby agrees that S E Ventures Inc., with their sole discretion, shall have the right to decline to grant such participation in the Activity or revoke at any time such credentials or the right to attend or take part in the Activity at Eagle Bay. The period of this agreement shall encompass December 1st 2017 to December 31st 20187. If for any reason the Property is closed to this Activity prematurely, the Releasor will be reimbursed for a percentage of the original fee paid based on the time removed from the one year agreed Activity period. This agreement is entered into and shall be governed by the laws of the Commonwealth of Virginia. This agreement extends to all acts of negligence by the Releasees, including any negligent rescue operations and is intended to be as broad and inclusive as is permitted by the laws of the Commonwealth of Virginia. If any portion of this Agreement is held invalid, it is agreed that the balance shall continue in full force and effect. ALL FAMILY MEMBERS, INCLUDING MINORS, THAT WILL BE AT EAGLE BAY -- INCLUDING NON RIDERS -- MUST SIGN THIS APPLICATION; IF MINORS ARE LISTED ON THIS APPLICATION BOTH GUARDIANS MUST SIGN, ACKNOWLEDGING THAT THEY HAVE READ AND VOLUNTARILY SIGN THIS AGREEMENT, WITH THE UNDERSTANDING THAT SUBSTANTIAL RIGHTS ARE BEING GIVEN UP. MINOR RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT IN CONSIDERATION of my minor child(ren) (the minor(s)) being permitted to enter for any purpose any RESTRICTED AREA(S) (defined to be any area which requires special authorization, credentials or permission to enter any area to which admission by the general public is restricted or prohibited), I agree that: I know the nature of the activity and my Minor’s experience and capabilities, and believe my Minor(s) to be qualified to participate in the activity. I will inspect the premises, facilities, and equipment to be used or with which my minor(s) may come in contact. IF I OR MY MINOR(S) BELIEVE ANYTHING UNSAFE, I WILL INSTRUCT MY MINOR(S) TO IMMEDIATELY CEASE THE ACTIVITY AND LEAVE THE RESTRICTED AREA. I FULLY UNDERSTAND and will instruct my Minor(s) that: (a) THE ACTIVITY IS VERY DANGEROUS and participation in this activity and/or entry into Restricted Areas involve RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by each Minor’s own actions, or inactions, the actions or inactions of others participating in the activity, the rules of the activity, the condition and layout of the premises and equipment, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW: (c) There may be OTHER RISKS NOT KNOWN TO ME or that are not readily foreseeable at this time; (d) THE SOCIAL AND ECONOMIC LOSSES and/or damages that could result from those Risks COULD BE SEVERE AND COULD PERMANENTLY CHANGE ANY MINOR’S FUTURE. I consent to each Minor’s participation in the activities and/or entry into restricted areas and HEREBY ACCEPT AND ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, AND ASSUME ALL RESPONSIBILITY FOR THE LOSSES COSTS AND/OR DAMAGES FOLLOWING SUCH INJURY, DISABILITY, PARALYSIS OR DEATH, EVEN IF CAUSED IN WHOLE OR PART, BY THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW. I HEREBY RELEASE, DISCHARGE AND COVENANT TO SUE the organizers, participants, trail designers, landowners and lessees of the premises used to conduct the activities and each of them, their directors, officers, volunteers, all for the purpose herein referred to as “Releasees,” FROM ALL LIABILITY TO ME, EACH MINOR, my and the Minor’s personal representatives, assigns, heirs, and next of kin, FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON ACCOUNT OF ANY INJURY, including but not limited to, death or damage to property, CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE. If, despite, this release, I, the Minor(s) or anyone on each Minor’s behalf makes a claim against the “Releasees” named above, I AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES and their insurance carrier, and each of them from ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS, LIABILITY, DAMAGE, OR COSTS THEY MAY INCUR DUE TO THE CLAIM MADE AGAINST ANY OF THE ‘RELEASEES” NAMED BELOW, WHETHER THE CLAIM IS BASED ON THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. In the event that a minor sustains any injury while in any Restricted Areas that any rescue personnel or medical personnel may release such medical information about the injured minor’s condition to representatives of the organizer, land owner, as necessary to allow such individuals to properly report that information to appropriate representatives of the insurance carriers. I sign this agreement on my own behalf and on behalf of the Minor(s). I HAVE READ THIS PARENTAL CONSENT, RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, UNDERSTAND THAT BY SIGNING IT I GIVE UP SUBSTANTIAL RIGHTS I AND/OR THE MINOR(S) WOULD OTHERWISE HAVE TO RECOVER DAMAGES FOR LOSSES OCCASIONED BY THE RELEASEES’ FAULT, AND SIGN IT VOLUNTARILY AND WITHOUT INDUCEMENT. I FURTHER CERTIFY THAT I AM THE PARENT OR LEGAL GUARDIAN WITH AUTHORITY TO EXECUTE THIS AGREEMENT ON BEHALF OF SAID MINOR(S).
